1. Digerati neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with Digerati.
2. While Digerati uses reasonable efforts to include accurate and up to date information in the Site, Digerati makes no warranties or representations as to its accuracy. Digerati assumes no liability or responsibility for any errors or omissions in the content of the Site.
3. Your use of and browsing in the Site are at your risk. Neither Digerati nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. 4. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post that does not fall within the guidelines of our Privacy Policy may be used by Digerati or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, Digerati is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.
5. Images of people or places displayed on the Site are either the property of, or used with permission by, Digerati. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission provided elsewhere on the Site. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
6. The trademarks and brand names used within the Site may be trademarks or registered trademarks of Digerati or other companies. For a list of the trademarks used on the Site (collectively, the “Trademarks”), please review our Trademark Notices page, which is herein incorporated by reference. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Digerati or such third party that may own such Trademark. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, is strictly and expressly prohibited. You are also advised that Digerati will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
7. Digerati has not reviewed the sites linked to the Site and is not responsible for the content of any off-Site pages or any other sites linked to the Site. If you follow a link to any off-Site pages or other sites, you do so at your own risk.
8. None of the software on this Site or underlying information or technology (collectively the “Software”) may be downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) any country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Commerce Department’s Table of Deny Orders. By accessing, using, or viewing (collectively, “using”) the Digerati.com website, you accept and agree that your use of the Digerati.com website, and any action or proceeding brought under or relating to these Terms & Conditions or your use of the Digerati.com website, are governed by the laws of the State of Texas, and any such action or proceeding must be brought in the federal or state courts of Texas, Harris county.
10. Digerati may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.
11. Permission to reproduce the copyrighted material of Digerati should be sent to the Copyright Agent at the address listed in Section 12.

A notification of claimed infringement must be a written communication provided to the designated agent that includes substantially the following:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Digerati to locate the material;

Information reasonably sufficient to permit Digerati to contact the complaining party, such as an address, telephone number, and, if available, an e-mail address where the complaining party may be contacted;

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and,
